1. Introduction

Aquidity Pty Ltd (ACN 120 088 084) (“Aquidity”, “we”, “us”, “our”) provides an online exam creation, delivery and marking platform for schools at onlineexams.com.au (the “Platform”).

We are committed to protecting the privacy of our users, including teachers, school administrators and students, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, use, disclose and protect personal information.

By using the Platform, you agree to the collection and use of information in accordance with this policy.

2. What personal information we collect

The only personal information we collect from users, whether a teacher, school administrator or student, is your email address, which is used to create and identify your account.

In addition to your email address, we hold information generated through your use of the Platform, which may be linked to your account:

• Exam content and results: exams authored by teachers, and exam responses, marks and results associated with a student account.
• Billing information: for school billing contacts, invoice history and licence details. Payment card details are collected and processed directly by our payment processor (Stripe) and are not stored on our servers.
• Usage information: log data such as IP address, browser type, device information, pages visited and timestamps, collected automatically when you use the Platform.
• Correspondence: information you provide when contacting us for support or enquiries.

We do not require or collect names, addresses or other identifying details as part of standard account registration. Where a school or teacher enters additional information about a student into exam content (for example, as a written exam answer), the school or teacher is responsible for ensuring they have the appropriate authority and, where required, parental or guardian consent to do so.

We do not collect or store government-related identifiers, such as NSW HSC candidate numbers. Where a teacher needs to identify which exam a student is sitting, this is done using the exam title and other non-government identifiers, not an HSC number.

3. How we collect personal information

We collect personal information:

• directly from you, when you register for an account, create or complete an exam, or contact us;
• from the school or teacher administering the Platform on behalf of students; and
• automatically, through cookies and similar technologies, and server logs.

4. Why we collect, hold, use and disclose personal information

We use personal information to:

• provide, operate and maintain the Platform, including creating, delivering, marking and releasing exam results;
• manage user accounts and school licences;
• process payments and manage billing;
• respond to support requests and communicate with users about the Platform;
• improve and develop the Platform;
• comply with our legal obligations; and
• protect the security and integrity of the Platform.

We do not use student personal information for marketing purposes.

5. Disclosure of personal information

We may disclose personal information to:

• Third-party service providers who help us operate the Platform, including our cloud hosting provider, payment processor (Stripe) and transactional email service. These providers are contractually required to protect personal information and only use it for the purpose for which it was disclosed.
• The relevant school, where information relates to a student or teacher account managed by that school.
• Regulatory or law enforcement bodies, where required or authorised by law.

We do not sell personal information to third parties.

6. Where your information is stored

Personal information collected through the Platform is hosted on servers located in Australia. If this changes, or if we engage an overseas service provider that will hold personal information, we will update this policy to describe the relevant countries and the safeguards in place, in accordance with APP 8.

7. Data security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including access controls, encryption in transit, and secure hosting. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Data retention

We retain personal information only for as long as necessary to fulfil the purposes described in this policy, or as required by law. Full details are set out in our [Data Retention Policy].

9. Access and correction

You may request access to, or correction of, personal information we hold about you by contacting us using the details below. Where a student’s information is managed through a school account, requests relating to that information should generally be directed to the school in the first instance.

We will respond to access and correction requests within a reasonable timeframe, in accordance with the APPs.

10. Cookies

The Platform uses cookies and similar technologies to maintain login sessions, remember preferences and understand how the Platform is used. You can control cookies through your browser settings, though disabling cookies may affect Platform functionality.

11. Children’s privacy

The Platform is used by students under the direction and supervision of their school and teachers. Student accounts and data are managed by the school, which is responsible for obtaining any necessary parental or guardian consent for students to use the Platform.

12. Changes to this policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the updated policy.

If you have a concern about how we have handled your personal information, please contact us using the details below. We will investigate and respond to your complaint within a reasonable timeframe.
